Introduction
Under the direction of the Chief of Party (COP), Deputy Chief of Party, and the Senior Advisor/Program Manager, and under the direct supervision of the Technical Project Manager, the incumbent will serve as a point of contact between PROJUSTICE and the Government of Haiti, the local bar associations, and the international donor community. The incumbent will also assist the development of legal strategies, policies and programs to develop the Haitian criminal justice system and reduce prolonged pretrial and illegal detention in Haiti.
Fonctions
The activities to be carried out by the incumbent consist of the following:
• Represent PROJUSTICE at meetings with members of the Haitian Government, members of the bar, local community based organizations and international donor organizations and report on the same.
• In coordination with the Senior Judicial Expert, remain informed of developments and discussions among and between the government of Haiti and the international donor community relating to the criminal justice system, including current and planned criminal justice policies and activities related to pretrial detention, and report on the same.
• Assess all relevant Government of Haiti and international donor committees working on criminal justice issues related to pretrial detention and make recommendations for actions PROJUSTICE may take to improve their efficiency and effectiveness.
• Remain informed of developments within the prison system, especially the prisons located in Port-au-Prince, Croix des Bouquets, Saint-Marc, Cap Haitien and Fort-Liberte, with particular attention to issues relating to prison population, prison crowding and pretrial release.
• Assist and support PROJUSTICE lawyers in the preparation of strategic documents on issues relating to the criminal justice system in Haiti, prolonged pretrial detention and PROJUSTICE’s activities on the same.
• Hold regular meetings with the Director of the Prison Administration and the Directors of the prisons in which PROJUSTICE is active and report on the same
• Together with the Senior Judicial Expert, ensure clear communication between PROJUSTICE and the Ministry of Justice and Public Security, the Supreme Judicial Council, the Prison Administration, the Magistrate’s School and the local bar associations about project activities related to criminal justice and pretrial detention, and/or any other subject matter that Criminal Justice Expert is qualified to handle that is assigned by the COP, DCOP, Senior Advisor or Technical Project Coordinator.
• Identify problems in the criminal justice sector on an ongoing basis and propose solutions to the Senior Advisor/Program Manager;
• Support judicial training activities (on the job and at the EMA) as related to criminal justice topics.
• Prepare periodic reports and success stories outlining the efforts undertaken by PROJUSTICE to reduce prolonged pretrial and illegal detention in project target jurisdictions.
• Perform other related activities as requested by COP, DCOP, Senior Advisor/Program Manager or Technical Project Manager.
Qualifications Requises
Law degree.
Thorough knowledge of Haitian criminal law and criminal procedure. Knowledge of land tenure a plus.
Seven to ten years of experience litigating criminal cases in Haiti, ideally at the levels of the Peace Courts (Tribunaux de Paix), Courts of First Instance (Tribunaux de Premier Instance) and the Courts of Appeal (Courts d’Appel).
Knowledge of and experience in the application of international standards and human rights in criminal cases, especially as it relates to cases involving illegal or prolonged detention.
Ability to interact with justice sector personnel at all levels, including judges, prosecutors, clerks, government officials and members of the bar.
Knowledge of judicial English and strong writing skills are a prerequisite.
Fluency in English, French, and Creole.
Technology-literate – PC skills, including MS Word, Excel, email and internet.
Position based in Port-au-Prince, with regular visits to Project Target Jurisdictions of Croix des Bouquets, Saint Marc, Cap Haitien and Fort-Liberté.
